Because they had honor back then. Also likely is that the death of Napoleon would cause widespread fervor in France. Also back then, when an army is defeated, the leader is captured not killed. The leader must then have his country pay ransom. Why kill someone when you can use him as leverage? A certain king of france was made to sign a treaty saying he would marry the daughter of another nation's king. I forgot who though.
