It's no different than the Bat Mobile. Anybody can buy one that was used in a movie or the TV show, but that doesn't give anybody the right to make a movie and sell tickets to it while using the Bat Mobile in it.

It's claimed in this thread that 'nobody knows who has the rights'. That quote suggests that WG knows very well who has the rights, has asked about said rights, but isn't finding people willing to talk about said rights.

i believe part of the issue is the age of the movie and the numbers of times the rights may have changed hands to parent companies

The tank also needs something to differentiate it from other Shermans, and Oddball told us what it was:
